Laguna Shores Resort 2019 Raffle
TERMS AND CONDITIONS: Participation in this Sweepstakes “Laguna Shores Resort 2019 Raffle” implies knowledge and acceptance by the participant of these rules and conditions. Any violation to the same or to the procedures or systems here established for the accomplishment of the present contest implies the immediate exclusion of the same and/or the revocation of the prizes.
1.- FROM THE ORGANIZER: The organizer of this Sweepstakes is “INMOBILIARIA GRUPO LAGUNA SHORES S. DE R.L. DE C.V” with domicile in Carretera Puerto Peñasco – Golfo de Santa Clara, km 4 CP:83550 Col.
2.- Permit number: #1675
3.- DRAWING TIME: This Draw will begin on September 4, 2019 and end on September 4, 2020, the date on which the draw will take place. Except modification of the present bases and conditions in very rigorous case any change will be massively notified.
4.- PRIZE: The only prize in this draw will be the Roxor Mahindra 2019 Automobile.
5.- BASES TO PARTICIPATE – OF THE PARTICIPANT: The ORGANIZER establishes as a condition to be considered PARTICIPANT, the PARTICIPANT must provide the following information, age and be over 21 years old, must be identified with official identification INE, PASAPORTE OR LICENCE, otherwise your entry in the draw will be invalidated, personal home address, personal telephone, email, marital status, annual income, The PARTICIPANT accepts that he is providing true information in each question according to the specifications and conditions detailed in the section, in case of not providing true information implies the immediate exclusion of the same and/or the revocation of the prizes. 6.- THE PLACE AND DATE OF THE DRAWING: The draw for this promotion will be held on September 4 at 12:00 pm in the presence of a Notary Public who will attest to the legality of the draw and the digital tools used in the raffle, in the pool area place located on Calle De las Almejas, Col. Laguna Shores CP: 83560 within the property of Laguna Shores Resort. The notification and award process will be as follows:
a) The winning participant will be notified by email and telephone within fifteen (15) business days from the date of the drawing.
b) Once notified of the same, must be presented at the home of the ORGANIZER (Carretera Puerto Peñasco – Golfo de Santa Clara, km 4 CP:83550 Col. Laguna Shores), proving their ownership and identity, through official identification INE, PASAPORTE OR LICENSE, within Fifteen (15) working days after notification to request your prize, and coordinate delivery.
c) in case the winner cannot prove his ownership and identity, or have violated the requirements of subsection 5) the draw will proceed to run again 45 days after the official date of the draw September 4, 2020.
7.- Raffle MECHANICS: A total of ten thousand electronic tickets (10,000) will be issued digitally using the JotForms platform that will maintain the participants’ registry, the tickets will be free of charge, the ticket will be the e-mail sent to the e-mail provided by the PARTICIPANT, the participants’ registry can be seen publicly at the following address https://www.jotform.com/table/92065527082053, and the winner will be chosen through the Random Picker software (https://randompicker.com/) which is a tool to choose from contests, sweepstakes or raffles.., and participants may purchase more than one ticket at the discretion of the ORGANIZER There will be only one winner of the winning Roxor Mahindra 2019 Automobile. In case the tax on the prizes is applied, it will be the responsibility of the participants who are winners. The ORGANIZER does not grant any guarantee of quality, eviction or redhibitory vices of the prizes. The mathematical probability of awarding prizes will depend on the number of participants involved and the number of participation numbers that the ORGANIZER grants according to the conditions established in clause 7. The prizes assigned and not claimed in the term established herein, if any, will be held by the ORGANIZER, who will determine the destination that will give them.
8.- OF THE AUTHORIZATIONS: THE PARTICIPANT that enters its data in the form previously mentioned authorizes the ORGANIZER and its associates to make use of the data, in the same way it is accepted as condition the activation of promotions by means of electronic mail to carry out the preliminary drawings and promotions. Whoever wins this promotion, expressly authorizes the ORGANIZER and those who designate for advertising, to disseminate their name, document number, personal data, prizes, images, photographs, voices and / or those of their family group if appropriate, for advertising purposes, in the media, ORGANIZER website and any other way it deems appropriate, without time limit and at no cost to the ORGANIZER.
9.- MODIFICATIONS: This promotion may not be suspended, cancelled and/or modified totally or partially, at any time, at the sole discretion of the ORGANIZER, however the date of the draw may be extended with prior notification through the mass media, and without the right to any claim on the part of the participants. The ORGANIZER is the unappealable organ that will interpret all and each one of the questions that are raised in relation to the present bases and conditions.
10.- PROHIBITIONS – LIABILITY: The participant who is the winner of this promotion may exchange or request the exchange of the prize obtained for cash with the market value of the Roxor Mahindra 2019 vehicle as of September 4, 2020.
a) The ORGANIZER The delivery of the vehicle will take place in the border city of Lukeville, Arizona. It does not include the procedure or payment of import of the vehicle in case the winner is a Mexican national, therefore the organizer is not responsible for the import of the vehicle and will be at the expense of the winner of the prize, also in case the winner does not have a visa to cross to the United States, the delivery may be made by a legal representative who proves this charge.
b) If the winning PARTICIPANT of the lottery is not present within the period indicated and in the conditions previously fixed and/or does not prove its condition as such, the ORGANIZER will proceed to conduct the lottery again as specified in paragraph 5 section a. Likewise, the ORGANIZER disclaims any type of responsibility for accidents that may occur during the transfer of prizes, since its performance as ORGANIZER ends with the delivery of the prize drawn to the PARTICIPANT who is the winner.
11.-MEDIA OF DISSEMINATION: THE ORGANIZER will have total use and diffusion of the draw by the means it considers necessary, among which will be used to inform the PARTICIPANT of the updates will be the following: Facebook, Twitter, JotForm, E-mails, Printed Media, and our official website www.lagunashoresresort.com.-
12.- OF APPLICABLE LAWS This promotion will be considered issued in accordance with the laws applicable in the United Mexican States. For all legal purposes arising from it, will be interpreted and executed according to and in accordance with the provisions and courts of this country. For the case of judicial dispute on the interpretation and fulfillment of each one of the terms of the present Bases and Conditions, it will be competent only the civil and commercial justice of the City of Puerto Peñasco Sonora; Mexico. of the same name, with express resignation of the PARTICIPANTS to all other jurisdiction that could correspond to it.
The mere fact of participating in this promotion, implies knowledge and acceptance without condition or reservation, by the PARTICIPANT, of each and every one of the clauses integrated in these BASES and CONDITIONS, without the right to complaint of any nature. Addendum
Taking into consideration the sanitary contingency that has occurred worldwide and that has greatly affected local tourism, and due to the changes authorized before the municipal authority Puerto Peñasco on July 10, 2020, the following modifications to the present raffle are informed,
- The period for issuing tickets and the date of the raffle has been extended until November 1, 2021.
The raffle will be held on November 1, 2021.- The number of tickets has been increased from 10,000 to 100,000.
We are still in the midst of the battle with this pandemic, which is why we have not been able to give more people the opportunity to participate for free, and due to the changes authorized before the municipal authority Puerto Peñasco on 29 Oct, 2021, the following modifications to the present raffle are informed.
- The raffle will be held on April 18, 2022.
